Illegal online filesharing is indeed a burning issue faced by not only the movie and music industry of the United Kingdom, but the content segment of the whole digital world. It is obvious that the creative industries lose millions due to the illegal online filesharing menace every year.

The cause of the issue is the so called broadband internet pirates that share music, TV and movie files illegally over the internet. It is also notable that many governments across the world have announced plans to tackle online illegal filesharing that is virtually crippling the creative industries.

However, the main issue faced by the authorities here is the majority of the people placed on the receiving end, of whom majority may be innocent as well. The implementation of any stringent laws could therefore cause unimaginable collateral damage when such people whose accounts are hacked by perverted professionals to share content illegally will also be brought to the guillotine.

In the United Kingdom, if it was the former telecoms minister Lord Carter that had proposed the anti-filesharing legislation in his Digital Britain report, it was the business secretary Lord Mandelson that took the initiative with a bit of urgency after the stepping down of Lord Carter as telecoms minister.

It is worth mentioning here that the government of the United Kingdom too, much similar to its counterpart in France has resorted to the three strikes plan which is all about a couple of warnings issued to the persistent illegal downloader followed by heavier measures such as throttling speeds or even temporary disconnection.

On the other hand, the implementation of any such laws – although will be welcomed by the minority creative industry – will be resented by many broadband users. The stance of these opposition will be that the ISPs should be acting against those websites that cater such illegal content instead of trying police the internet. It is also significant that many broadband providers such as TalkTalk have announced support to these common people that may suffer due to the implementation of an unpolished legislation.

A group of exuberant internet service providers operating in the United Kingdom must have enjoyed as well as welcomed a fresh verdict given by the Australian Federal Court that a broadband provider of down under, which was accused of allowing copyright infringement by its customers was not responsible for the offense.

As a matter of fact, accusation was made against the Australian internet service provider, iiNet by the Australian Federation against Theft of Copyright, on the grounds of authorising theft of copyright content by its customers. The case was brought forth by a joint force including all major studios of Hollywood.

The judge, following a trial hearing, ruled that whilst the ISP provided the means for downloading copyright content for its customers, it hardly authorised infringement; and the blame was put on Bit Torrent, the P2P application.

According to the judgment that ruled out iiNet’s involvement in the infringements, the violations of copyright had directly occurred as a result of the use of the P2P application Bit Torrent system and not the internet use. It further noted that the respondent neither created nor controlled the P2P application, furthermore it also did not enjoy the power to prevent the occurring of those infringements.

In the United Kingdom, the government has already proposed that the broadband providers operating in the country must be held responsible for issuing warning letters, and potentially disconnecting the broadband internet connections of still persisting illegal filesharers.

TalkTalk, the leading business broadband provider operating in the United Kingdom has told the Members of the Parliament and Peers last day that copyright content of the internet could not be protected by the Digital Economy Bill.

In the case presented by TalkTalk, one of the leading internet service providers in the country that offered broadband and home phone bundle packages it was categorically outlined that the Bill would only encourage the consumers to come up with fresh methods to tackle the implemented restrictions.

Furthermore, the broadband provider showed in its case, examples of a few of the tools, which were avalilable for the people currently to carry on with the illegal filesharing practices evading the restrictions.

The examples shown by TalkTalk included tools to rip cpyright material from iPlayer-like music players and the TV, non-UK websites, which streamed sporting events at pay-per-view, services that conceal the IP addresses of consumers with a view to avoid detection, and application to catalogue after downloading tracks from chosen artists by scanning internet radio stations.

Meanwhile, the broadband provider also stressed the point that financial requirements were not always the reason behind the users resorting to cppyright content theft, but a good number of people were simply irked by the restrictions – on the media on sales – by the digital rights management.

The launch of the new tool that may be dubbed piracy detector, would coincide with the launch of its subscription service of music downloads that has been already planned.

The software tool that detects the depth of online piracy, has been named by the firm that had developed it, as the Cview tool. The company that realised the tool is Detica, a technology and business consultancy , and it aims at optimising their tool to help the creative industries as well as the broadband providers in the country to recognise the digital piracy levels in the United Kingdom.

The software tool would enable the broadband suppliers of the country to apply to anonymous high-volume data traffic, advanced analytics to measure the quantum of illegal data downloading without storing or identifying the user data.

Detica, the firm behind the emergence of the new software tool, has claimed that the tool carries the potential to measure unauthorised online filesharing across all networks of internet service providers in the United Kingdom, to realise the collaboration between the government and industry with a view to respond to the illegal downloading challenge that has been mentioned in the Digital Britain report.

It has been reported that the intelligence services and the police of the United Kingdom have made an appeal to the government to drop its anti-filesharing legislation proposal highlighting the disconnection of the broadband internet connections of the persistent illegal filesharers.

To substantiate their appeal, the intelligence services and the police have cited the fact that such a development would culminate in making it more difficult to apprehend criminals at work. Their concern over this matter has been expressed by the services in an article published by the UK newspaper the Times.

As a matter of fact, both the United Kingdom police force and the national security services, which include MI6 and MI5 have given their belief that the criminals would escape conviction by resorting to encryption, which in its turn would increase not only the expenditure, but also the workload of the responsible internet monitoring staff.

The newspaper has reported one source of saying that the spooks simply hated this tactic, which they thought was only good for making monitoring the internet more complicated.

Meanwhile, Lord Mandelson, the business secretary of the United Kingdom, has pledged that he would put into force in the upcoming Digital Economy bill, fresh measures to deal with illegal downloading of films and music by disconnecting the broadband connection of piracy suspects.

On the other hand, UK broadband providers such as TalkTalk and BT have been found quite vocal in showing their displeasure over the suggestions of Mandelson that the illegal filesharers should be thrown out of the internet without a trial.
