Orange increases charges for service, violating the rules

According to ‘Orange’, the network operator, it has every right to increase the price if found necessary anytime during the contract period of 12 months, as per the terms and conditions with the consumers. Only it should be within the RPI (Retail Price Index) figure which is currently 5.4%. It means that the customers cannot terminate the contract.

But ‘Ofcom’, the regulator, said that the consumer has every right to terminate the contract if he chooses and that no penalty can be imposed. As per the rule, the operator has to inform the customer at least one month in advance if there is any price rise on any account. It will enable the consumer to withdraw the contract without any penalty.

But Orange is firm that it has the right to increase the price and it has nothing to do with material detriment. The RPI rate fixed by the government is 5.4% and the price increase by it is only 4.34%.

Peter McCarthy, the reputed lawyer declared that the terms and conditions of Orange will stand until it is legally challenged successfully as ‘unfair’. As per the law, a clause will become ‘unfair’ if it lets a seller to raise the price without giving a chance for the consumer the right to cancel the contract if the price rise is too much with respect to the original price at the time of the contract”. That means the consumers can fight it out in the court.

The online watchdog ‘MoneySavingExport.com’ has also advised the customers to involve Ofcom to settle the matter amicably. If not they can take up the matter with the CISAS (Communications and Internet Services Adjudication Scheme), which is a free and independent body to settle the disputes between the consumers and the internet service providers.

Two years Orange was in a similar position but was forced to withdraw the price hike it imposed on the consumers. At that time it had stated that it will not take any such measures in future. But it is now repeating the same.
