Leaving Demon in first 12 months!?
Hello everyone,

I've been with Demon for 4 months, and have fallen foul of their Fair(?) Usage Policy.

My speed had been restricted to 128kbs. I phoned up to try and cancel and was told i need to pay for the remainder of the year, about £180 I was told.

Is this true? I have heard of people being able to leave when they are on there FUP restrictions... Does anyone have any experience of this and what I should do?

Generally you signed a 12 month contract, to leave you will need to pay off that contract.

Have they limited you permanently or just until the end of your billing month? If its permanently you could argue that they have breached your contract although not sure how successful you would be. If its an "unlimited" package you could also try to claim its misleading, especially if the FUP is very low.

Out of interest how much bandwidth are you using, and what's the FUP on Demon?

It's just until he falls back under the usage limits. Usage is measured under a rolling 30 day period.

The bandwidth limit is 50GB for Home 8000 and 60GB for HomeOffice 8000 and RSL HomeOffice customers. There is no limit for customers on business plans (which start at£34.00 a month exc VAT). Here is the demon fair use policy: Fair Usage Policy FAQ

To be honest, don't think you have very much to complain about considering that you've evidently done hugely excessive amounts of movie or music downloading to hit the limit.

What does the contract state as far as speed. If you are given a speed on a contract that does not fall into the guidelines of the contract then you are not obligated to pay the remaining balance of the contract as they would be in breach of contract. Contact an attorney if necessary, as they may have to pay back all the service time you have used and let you off the hook.

Did you actually read the rest of the thread? He agreed to the Fair Use Policy in signing up. He was using unreasonably excessive amount of bandwidth for the plan he paid for, so Demon put him on a temporary speed restriction.
